Behavioral Policy For The Cetsy Community
Community equality and global trade for all is our goal at Cetsy. We encourage our sellers to use
community spaces to connect with others, share inspiration and knowledge, team build and to
further their existing careers or expand into new opportunities.
The Cetsy Community includes future Forums and the Cetsy Chat. This policy is part of
the Cetsy House Rules. By using our community spaces, you are agreeing to this policy and our
House Rules.
The Cetsy Community
Community spaces within Cetsy are public areas where sellers can interact with other sellers.
Buyers and Sellers must be 18 years of age and above. To make certain that our Cetsy community
continues to be a great and safe place, you agree to comply with all listed policies in all
Cetsy community spaces:
Respect everyone’s privacy, including your own. You know that it is not safe to
share private or personal information in public spaces, like forums, in the site. Do not do it.
This includes, and is not limited to, details of transactions, exact copies of private messages,
personal details such as address, financial information, bank
details etc.
One should not use community spaces to discuss interactions with Cetsy
representatives, nor should one share copies or extracts of conversations(for example:
emails,
messages/DM’s, live chats, etc.) . In other words, do not share correspondence with
anyone other
than the individual you communicated with, unless a Cetsy representative asks you to share the
messages with us in order to settle some disagreement that may be present.
No fake IDs or documents are to be used by any Buyer or
Seller on
Cetsy.
Be respectful to all individuals and be kind and, when in doubt, assume the best
intentions and
act with patience and an understanding behavior as you would have others do unto you. Please
never use Cetsy community spaces to publicly disgrace, humiliate, or slander a specific seller,
buyer, Cetsy rep, listing, shop, or category of any item.
Do not interfere or cause turmoil with others. Always act with a kind
heart.
This
includes unsolicited, links to your shop, fundraisers, duplicate posts, surveys,
social media or other promotional content.
However, there is ONE TYPE OF SPAMMING WE DO ENCOURAGE. Read
closely: Sellers, when a potential
buyer favorites your ITEM(S) they are saying, “Hello, I like
your item.” That’s your que to say
something briefly in return. Perhaps, you can send them a “Welcome to my shop, we are always
available for questions and some item prices are flexible” In other words, it is not
spamming if
the potential buyer favorites your item and you decide to message them to open a conversation
with them. If a potential buyer favorites multiple items in your shop, please refrain from
sending them the same message over and over.
Sellers should not use future community spaces and coordinate pricing nor should there be any
discussions of fee avoidance with other sellers.
And please, do not use community spaces to harass other sellers or to shame buyers. As well,
there should be no posting of content within Cetsy community spaces that glorify hatred, racism,
sexism, unethical behavior, or provide misinformation. There should also be no threats of
violence towards others.
One should never infringe upon someone's intellectual property rights nor should one encourage
others to engage in that type of activity. Follow the law and come up with your own ideas. And
please, do not encourage others to break the law for your benefit and do not encourage others to
violate our policies.
FORUMS
Always keep in mind that forums are a public space where sellers can gather with other sellers
and discuss their Cetsy businesses in a way that will benefit all sellers in a safe space on a
public database. Thus, providing valuable knowledge for everyone, everywhere.
Therefore, always lead with empathy and kindness and remember that “tone” is sometimes difficult
to interpret. When in doubt, say nothing.
Always respect the opinions of others and report content honestly. Flagging of posts is reserved
ONLY for content that specifically violates our Cetsy House Rules. We also reserve the right to
remove content from the Forums at any time and for any reason. We will remove dormant content
and anything that violates our policies or causes issues with privacy or the way the Forum is
operating.
DIRECT MESSAGES
Members should always send each other messages directly by using Cetsy's internal messaging
system. Always refrain from abusive, disrespectful, obscene or vulgar language. DO NOT BE
RACIST/SEXIST.
There should be no unsolicited advertising or promotions.
If you receive an inappropriate message, report the content to Cetsy. You can always reach us by
way of our various emails, a telephone call, or via our online chat.
CETSY VIOLATION ACTION POLICY
Should an individual or moderator notice an item or communication
that appears to “not conform” to the Cetsy marketplace, we encourage the individual or moderator
to report the Seller and / or item/ communication to Cetsy for further review.
Cetsy will review the claim within 48-72 hours and make a
determination as to whether or not the “Listing /Communication” conforms with or violates Cetsy
House Rules, our Restricted Items Policy and/or our Behavioral Policy.
Should Cetsy determine that the “Listing/Communication” conforms
with/and does not violate our Cetsy House Rules, our Restricted Items Policy and/or our
Behavioral Policy, no further action will be taken.
Should Cetsy determine that the “Listing/Communication” does not
conform with/and violates our House Rules, our Restricted Items Policy and/or our Behavioral
Policy, Cetsy will be in immediate contact with the owner of the “Listing/Communication”.
The “Listing/Communication” owner will be messaged via Cetsy
Messages and will be given a 48-hour notice to remove the “Listing/Communication”. Should the
“Listing/Communication” remain posted beyond the 48-hour time period, Cetsy reserves the right
to remove the “Listing/Communication” and/or suspend the user’s account.
Service Level Response Times
In the event of a service outage or a request for assistance from the Merchant, the Transaction
Processor will acknowledge receipt of this communication immediately when it is received and
will endeavor to resolve the problem within the shortest time possible of the acknowledgement
and in consultation with other stakeholders.
Behavioral Policy for The Cetsy Community/ Indemnity General
The parties agree that they will not perform or fail to perform any act that would violate the
laws of the United States, including but not limited to the laws of the State of Ohio.
Furthermore, they agree to defend, indemnify, and hold harmless the Cetsy.co platform from any
and all claims, actions, suits, losses, damages, liabilities, and costs, including reasonable
attorneys' fees, arising from or related to any violation of, or failure to properly comply
with, applicable federal, state, or local laws, rules, or regulations resulting from any acts or
omissions by the parties.
Similarly, Cetsy.co agrees that it will not perform or fail to perform any act that would violate
applicable laws and further agrees to defend, indemnify, and hold harmless the Members from any
and all claims, actions, suits, losses, damages, liabilities, and costs, including reasonable
attorneys' fees, arising from or related to any violation of, or failure to properly comply
with, applicable federal, state, or local laws, rules, or regulations resulting from any acts or
omissions by Cetsy.co.
General
Language
This Agreement and any notices to be given shall be in the English language. Where texts exist in
more than one language, including any part of this Agreement, the English language text shall
govern.
Disclaimers
Cetsy reserves the right to change the terms and conditions of our Ad programs at any time,
including addition of fees, addition or removal of platforms, or end the program (in whole or
part) at our sole discretion and at any time. We will notify you of any major changes, if any.
When using our advertising and promotional services, it does not constitute an obligation on
Cetsy's part to display your ad or promote your listings or shop(s). As well, Cetsy cannot
guarantee that a displayed ad or promo item will be clicked by a potential buyer, nor can we
guarantee that if a user clicks on a listing that the related listing will be sold.
Our advertising services and advertising policies can change over time, due to the fact that
third party channel partners policies change. As such, neither Cetsy nor its third-party channel
partners can guarantee any particular program's features, results, or actual third-party
channels. Cetsy.co reserves the exclusive right to modify or end any campaign, incentive, offer,
or any program that is in part or as a whole and at any time.
Cetsy could, and you give Cetsy permission to, automate parts, a part of, or all of an
advertising service provided, including combining any bids across listings, geographical
regions, keywords, ad formats, verticals, on and /or off of Cetsy marketing channels and / or
platforms. And, you give Cetsy permission to do so, with notice from Cetsy, even if those
features or options substitute the parameters and options you set for that particular
advertising service.
Should Cetsy begin, end or modify an advertising service, you grant Cetsy permission to transfer
your bids, budgets, and campaigns to that new program, to the extent transferable for the
defaults and features of the new or updated ad service. Cetsy will provide notice to the
advertiser/seller in the event of any such transfer.
The seller may be given the opportunity, from time-to-time, to participate in beta tests
regarding advertising services offered by Cetsy and/or any of our third-party channels. Please
note that any such beta service is subject to separate terms for that particular program
provided to the seller as part of their participation in that program, as well as this policy
and the overall Cetsy House Rules.
Once in a while, we may experiment or test using additional advertising products and as such the
advertising services offered to the seller by Cetsy, as well as the look, design, and feel of
any type of advertisement, could change as our programs and or platforms / channels further
evolve.
No ad or promotion should include content that infringes upon / violates the
rights of any third party, to include but not limited to: copyright, trademark, privacy,
publicity, or other personal or proprietary rights of that individual or business.
The seller is responsible for ensuring that their promotions and ads are in accordance with all
applicable laws and regulations.
Cetsy Limited exclusively reserves the right to reject or remove any ad or promotion for any
reason, and in our sole discretion, to include any marketing that may negatively affect our
relationship(s) with our members and / or partners.
Privacy Policy/ Listing Fees/Payment Processing Fees
Please be aware of applicable charges when transferring funds from your Seller account to
external accounts. These charges are determined by the payment processor or gateway you choose
to use.
